ADDITIONAL PRIVACY NOTICE FOR JOB APPLICANTS

This notice incorporates all terms, conditions and disclosures detailed in our Privacy Policy.

Through our career page on the Websites, you can currently view open vacancies at our locations worldwide and apply for these vacancies via the “Careers” section of our Websites. In doing so, you will be redirected to our service provider SAP SuccessFactors (“SuccessFactors”). Before creating your account with SuccessFactors you will be asked for your prior consent and acceptance of it’s Privacy Policy to use our SuccessFactors Application Portal. Data Processing outside the European Union:

SuccessFactors is a service provided by a provider from the United States. The processing of personal data therefore takes place outside the European Union. Abiomed has agreed to a data processing addendum with SAP Success Factors Inc. which includes EU standard contractual clauses.

a.    Which data are processed for which purpose

As part of the interview and hiring process, we collect and process the following categories of personal data:

  • Contact data in your candidate profile (e.g. first and last name, country, e-mail, telephone number);
  • Information from the application form (this includes, for example, salary requirements, your motivation, information on disability, if applicable (only if relevant for the advertised position);
  • Application documents (this includes, for example, CV, cover letter, data on professional development, qualifications and language skills);
  • Results of online tests (e.g. personality tests, cognitive performance tests, other psychometric procedures) and video interviews if applicable; and
  • If applicable, references that you provide us with.

We may also obtain the above data about you from other sources, including external business partners, e.g. recruitment agencies. We may also receive data that you have made public on job-oriented social networks, such as LinkedIn, or that you submit to us through third-party websites, such as Monster Job Board, Stepstone or from other publicly available sources (only if the data is relevant to your professional life). The purpose is to contact you about job offers or to verify the accuracy of the information you provide in your application.

Your personal data will be processed exclusively for the following purposes:

  • Initiation and establishment of the employment relationship
  • To contact you if you should be considered for an alternative position. 
  • Provided you have given us your consent to ask you about your satisfaction with the application process.
  • To contact you based on your unsolicited application.

b.    What is the legal basis on which these data are processed?

We collect and process your personal data to offer advertised positions and to be able to carry out the selection process. For certain positions (e.g. trainees, internships) this also includes your participation in an online procedure (e.g. personality tests, cognitive performance tests)). The legal basis for this is § 26 (1) in conjunction with para. 8 sentence 2 Federal Data Protection Act (BDSG)  and § 22 para. 1 b) BDSG. The data provided by you is necessary for the processing of your application. If an employment relationship is established, this data will also be processed for the purpose of carrying out the employment relationship.

If we obtain information from your public profile on professional social networks, we base the processing on our legitimate interest in forming a basis for a decision to establish an employment relationship with you. 
We may base any processing on your consent (e.g. if we ask you about joining our talent management or our job posting information.)

Furthermore, we can process your personal data, as far as this is necessary to defend against legal claims asserted against us in the application process. The legitimate interest is, for example, a duty of proof in proceedings under the Federal General Equal Treatment Act (AGG) of Germany.

c.    Are there other recipients of the personal data besides the person responsible?

In addition, personal data may be processed on our behalf based on contracts, by providers of systems for applicant management and applicant selection procedures. Personal data will not be transferred to third parties if there is no connection to the applicant management and applicant selection procedure or if it is not used for the purposes described in the section "purposes of processing personal data".

Such transfers may involve the transfer of personal data to recipients outside the European Union / European Economic Area. Standard contractual clauses have been concluded with these external service providers, if they are not based in countries with an adequacy finding.

We reserve the right to disclose information about you in the event of a legal obligation to do so if we are required to do so by lawful authorities or law enforcement agencies. 

d.    How long is the data stored?

We store your personal data in your candidate profile for a period of 6 months after your last registration. This is necessary for the duty of proof in proceedings under the AGG. In case you join our talent management, we store your data for this period in case of an alternative job advertisement for which you are a suitable candidate. You can adjust the visibility settings in your candidate profile at any time, as described in the section Recipient of the Data. You can also request the deletion of your candidate profile or the withdrawal of your application by contacting us at [email protected].

If your application is successful, we will store your personal data for the entire duration of your employment relationship in accordance with the Employee Privacy Policy that we send you when we accept the employment.
