ADDITIONAL PRIVACY NOTICE FOR USERS IN THE EUROPEAN UNION

This notice incorporates all terms, conditions and disclosures detailed in our Privacy Policy.

If you are a European Union resident or are otherwise a data subject covered by the European Union’s General Data Protection Regulation (GDPR) or similar national laws, you may have certain rights in relation to your personal information.

You will not have to pay a fee to exercise any of these rights. However, we may charge a reasonable fee if your request is repetitive or excessive, or we may refuse to act on the request.

We try to respond to all legitimate requests in a timely manner. Occasionally it may take us longer if your request is particularly complex or you have made several requests. In this case, we will notify you and keep you updated.  We may also need to contact you about your request to verify your identity, confirm certain information, or clarify the request before we can fulfill the request.

Abiomed processes your personal data only on the following legal grounds:

  • Your prior consent
  • To fulfill contractual obligations
  • Legitimate interests of Abiomed or Third Parties

In cases where we rely on legitimate interests for the processing of personal data those interests are described in Abiomed’s Privacy Policy.

Data Processing Outside the European Union/European Economic Area

Please be aware that data entered onto our European Union Websites may be processed outside the EU only under those circumstances described in Abiomed’s Privacy Policy.

Through the judgment of the European Court of Justice C-311/18 ("Schrems II") the EU-U.S. Privacy Shield Framework has been declared invalid. According to this ruling, due to the intelligence gathering activities of U.S. authorities, there is no level of protection afforded in the US to EU data subjects that corresponds with the level of protection required under GDPR.

Since the Schrems II judgment, Abiomed has adjusted our agreements with our service providers and partners with regard to the transfer of data to third countries - in particular by concluding so-called standard contractual clauses (SCCs) in accordance with Art. 46 Para. 2(d) of GDPR - and are still exchanging information on further necessary adjustments.

Since it is currently unclear whether and which adaptations of the standard contractual clauses are necessary, we would like to transfer personal data, as far as possible, only with your explicit consent pursuant to Art. 49 Para. 1(a) of GDPR. 

We therefore provide notice to you that the USA is not a safe third country as determined by the European Court of Justice for transfers of EU data subjects’ personal data. US companies are obliged to surrender personal data to law enforcement and intelligence agencies without you, the data subject, being given a meaningful opportunity to object to such disclosures. Therefore, Abiomed cannot exclude the possibility that US intelligence and national security authorities may process, evaluate and permanently store your data on US servers for monitoring purposes. We have no influence on these processing activities. If you give us permission to transfer data, e.g. via the cookie settings, you can withdraw your consent at any time by changing the settings. However, this has no influence on data already transmitted.
